Beginning on March 15, 2014, all draft regulatory legal acts concerning the professional activities of medical workers, which are developed by the Ministry of Health, will be discussed with the National Medical Chamber.
The corresponding order, “On Interaction of the Ministry of Health of the Russian Federation with the Non-Commercial Partnership ‘National Medical Chamber’ in the Preparation of Regulatory Legal Acts Concerning the Professional Activities of Medical Workers,” was signed by the Minister of Health of the Russian Federation the day before.
“In a sense, this event can be called historic. We talk a lot about the need to create public-state governance of professional activities. Now the conditions have been created to implement this in practice, – says Leonid Roshal, President of the National Medical Chamber. Today the National Medical Chamber is the largest public association in Russia and, in accordance with regulatory acts, can officially represent the medical community.”
The order defines the procedure for interaction between the Ministry and the NMC at all stages of discussion and approval of draft regulatory acts.
Thus, 30 days before the broad public discussion of a draft regulatory act, the developers send its copy with an explanatory note to the NMC; the Chamber organizes its review with the involvement of relevant specialists, prepares a conclusion (with proposals and comments attached, if any), and, if necessary, holds negotiations with the developers within the framework of the work of the Coordinating Council between the Ministry of Health of Russia and the NMC. If there are unresolved disagreements at this stage of approval, the final decision on the need to revise the regulatory legal act or take the proposals into account is made by the relevant Deputy Minister of Health of the Russian Federation.
Then the revised draft regulatory legal act is posted by the developer on the official website in the information and telecommunications network “Internet” http://regulation.gov.ru/ for public discussion. The draft regulatory legal act is also posted on the official NMC website (www.nacmedpalata.ru).
After public discussion, the developer, together with the specialized working group of the Coordinating Council, reviews all comments and proposals on the draft and sends the final version of the draft regulatory legal act to the NMC with a covering letter containing information on the progress of the development and discussion of the draft, as well as justification for the proposals not taken into account. Then the NMC reviews the draft NMC within up to 5 working days. If the NMC agrees with the content of the draft, it is approved by the organization’s management and sent to the Ministry. If there are comments, the corresponding conclusion of the NMC is sent. At the final stage of approval, the Minister makes the final decision on the draft regulatory legal act.
“The National Medical Chamber creates conditions for more confident work by the ministry so that well-developed documents can emerge. Unfortunately, recently they have often been released without sufficient elaboration,” – Roshal notes.
Thus, the National Medical Chamber assumes responsibility for the decisions made by the Ministry of Health of Russia concerning professional activities.
