Assessment of the draft law on protecting doctors, adopted by the State Duma in the first reading on June 16, 2017
The National Medical Chamber has been promoting the draft law on protecting doctors for a long time. As early as last October, together with experts from the All-Russian State University of Justice (RPA of the Ministry of Justice of Russia), the draft “On Amendments and Additions to the Criminal Code of the Russian Federation and the Criminal Procedure Code of the Russian Federation” was prepared. It was submitted to the Ministry of Health of the Russian Federation.
In this draft law, a fundamentally new approach to strengthening liability for causing harm to the life and health of a medical worker was proposed — the introduction of a separate legislative provision. Unlike other draft laws presented at that time, the Chamber’s experts proceeded precisely from the criterion of the social significance of the medical profession, since as a result of causing harm to the life and health of a medical worker, not only the worker suffers, but also patients who are left without the ability to promptly receive medical care.
According to the experts of the National Medical Chamber, it was precisely the social significance of the medical profession, as well as the high importance of the sector for the country’s national security, that necessitated serious changes to the Criminal Code of the Russian Federation. The Ministry of Health supported this initiative of the professional community. The proposed penalties for causing harm to medical workers were very severe. Thus, for using violence dangerous to the life or health of medical workers, it was proposed to punish by imprisonment for up to ten years. And for encroachment on the life of a medical worker in connection with the performance of professional duties in providing medical care, it was proposed to punish by imprisonment for a term of twelve to twenty years with restriction of liberty for up to two years, or life imprisonment. Such an approach was not accepted by lawmakers. On June 16, 2017, the variant of the draft law prepared by Deputy Speaker of the State Duma Irina Yarovaya and Chairman of the State Duma Committee on Health Protection Dmitry Morozov was adopted in the first reading . In it, the deputies propose to include in the Criminal Code of the Russian Federation a provision on the criminal liability of persons who obstruct medical workers from providing assistance to patients — Article 124-1.
To form the position of the medical community on this draft law, we ask you to review it and give your assessment.
